Recent allegations against Bill Cosby fall square within the statute of limitations

It seems there’s a good chance that Bill Cosby could finally face charges related to sexual assault. Sources say that model Chloe Goins is expected to file charges with the Los Angeles Police Department for an assault she alleges occurred at the Playboy mansion in 2008.

Making these recent allegations unique is that they allegedly occurred within the statute of limitations for rape cases, which currently stands at 10 years in California.

Speaking to the Daily Mail last month, Goins said that Cosby gave her a mixed drink, and then helped her to a bathroom to lay down when she began feeling dizzy.

“I came to and remember seeing this big man crouched over me,” Goins said. “It was Bill Cosby and he was at my feet, kind of licking and kissing them and I think he bit my toe as that’s what woke me up. I kind of thank God for that because that’s what woke me up and I came to.”

“I was shocked, I said, ‘hey, what’s going on’, he didn’t really say anything, didn’t explain anything or give a reason,” she added. “He jumped up, pulled his pants back up quickly and left. He had seen that I was alert and bolted out of there, I was left in the room by myself.”

She claimed that she didn’t go to the police at the time out of fear that her career would be damaged.

“This isn’t something I really wanted out there about myself, but I saw all the women who had come forward, over 20 women and it grossed me out. I feel he needs to pay for it, he deserves to pay for it,” she said. “Unlike many of those women, I don’t think he raped me so I am one of the lucky ones, but at the same time it was a fucked up situation.”

    SB 926, Beall. Crimes: statute of limitation: felony sex crimes.
    Under existing law, prosecution for specified felony sex offenses, including rape, sodomy, lewd or lascivious acts, oral copulation, continuous sexual abuse of a child, and acts of sexual penetration, that are alleged to have been committed when the victim was under 18 years of age, may be commenced at any time prior to the victim’s 28th birthday.
    This bill would authorize prosecution of those crimes at any time prior to the victim’s 40th birthday when the crime was committed on or after January 1, 2015, or for which the previous statute of limitations has not run as of January 1, 2015.

    THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

    SECTION 1. Section 801.1 of the Penal Code is amended to read:
    801.1. (a) (1) Notwithstanding any other limitation of time described in this chapter, prosecution for a felony offense described in Section 261, 286, 288, 288.5, 288a, or 289, or Section 289.5, as enacted by Chapter 293 of the Statutes of 1991 relating to penetration by an unknown object, that is alleged to have been committed when the victim was under 18 years of age, may be commenced any time prior to the victim’s 40th birthday.
    (2) Paragraph (1) shall only apply to crimes that were committed on or after January 1, 2015, or for which the statute of limitations that was in effect prior to January 1, 2015, has not run as of January 1, 2015.
    (b) Notwithstanding any other limitation of time described in this chapter, if subdivision (a) does not apply, prosecution for a felony offense described in subdivision (c) of Section 290 shall be commenced within 10 years after commission of the offense.
