Justice Ruth Bader Ginsburg: ‘I wasn’t 100% sober’ during Obama’s SOTU speech

After a pic of Supreme Court Justice Ruth Bader Ginsburg apparently nodding out during Obama’s latest State of the Union Address went viral last month, there was some speculation as whether or not the famously liberal Justice was actually dozing or not.

But during a talk at George Washington University this week, Ginsburg spilled the beans:

“The audience for the most part is awake, because they’re bobbing up and down, and we sit there, stone-faced, sober judges. But we’re not, at least I wasn’t, 100 percent sober.”

“Because before we went to the State of the Union, Justice Kennedy brought in … it was an Opus something or other, very fine California wine, and I vowed this year, just sparkling water, stay away from the wine, but in the end, the dinner was so delicious, it needed wine,” Ginsburg said.

She added that her fellow Justices were aware that she was drifting. David Souter elbowed her a few times when he saw her nodding off.
